What Unlicensed Real Estate Virtual Assistants Can Do in Arkansas
The state of Arkansas does not have particular regulations concerning what a real estate personal assistant can and cannot do. However, it clearly asserts the responsibilities of a real estate agent, from which one can infer the tasks that unlicensed assistants are allowed to perform and the ones they are not.
The list below contains the duties that are to be carried out exclusively by a licensed person, and therefore cannot be performed by the real estate agent assistant:
- Sell, purchase, exchange, lease or rent real estate;
- Offer to sell, purchase, exchange, lease or rent real estate;
- Offer, attempt, negotiate or agree to negotiate the sale, purchase, exchange, lease or rent of real estate;
- List, attempt, offer or agree to list real estate for lease, exchange, or sale;
- Auction, attempt, offer, or agree to auction real estate; take part in a real estate auction;
- Collect, attempt, offer, or agree to collect rent;
- Advertise themselves as working in the real estate sector;
- Assist or instruct the acquiring of prospects meant to result in the sell, purchase, exchange, lease or rent real estate;
- Assist or direct the negotiations of the transactions meant to result in the sell, purchase, exchange, lease or rent real estate;
- Charge an advance commission for any contract undertook in order to promote the lease or sale of real estate.
So what does a real estate assistant do? They can engage in clerical tasks, such as answering the phone and taking messages for the licensee, making appointments on behalf of the licensee, filling in contracts and documents as instructed by the real estate agent they work for. They can also take part in open houses and showings, but always in the company of a licensee.
